Commercial Cleaning Machines – Hire Terms & Conditions
These terms apply to all equipment hired from Commercial Cleaning Machines Pty Ltd (“CCM”). By submitting a hire form or taking possession of the equipment, you (“the Hirer”) agree to the following conditions.
1. General
The Hirer agrees to hire the listed equipment for the period and price specified. CCM retains ownership of all equipment at all times.
2. Hire Period
- The hire period begins on the agreed collection or delivery date and ends when the equipment is returned to CCM or collected by CCM.
- All hire extensions must be approved in writing before the original return date.
- Late returns will be charged at the standard daily rate until returned.
3. Hire Fees & Bond
- A $500 refundable bond is required prior to collection or delivery.
- The bond will be held as security against loss, damage, late return, or cleaning costs and refunded within three (3) business days once the equipment is returned in good condition.
- Hire fees are payable in advance unless otherwise agreed in writing.
4. Responsibility for Equipment
- The Hirer is responsible for the equipment from the time it leaves CCM’s possession until it is returned.
- The equipment must only be used for its intended purpose and operated safely at all times.
- The Hirer must keep the equipment secure, protected from theft, damage, and misuse.
- Equipment may not be loaned, sub-hired, or relocated without written consent.
5. Damage, Loss & Cleaning
- The Hirer is liable for all loss, theft, or damage to the equipment during the hire period.
- All repairs or replacement costs will be deducted from the bond or invoiced separately.
- If equipment is not returned or is damaged beyond repair, CCM may charge the full replacement value.
- Equipment must be returned clean and free from debris; additional cleaning charges may apply.
6. Operation & Safety
- Only competent and trained operators are permitted to use the equipment.
- The Hirer acknowledges they understand the safe operation procedures and will follow all safety instructions.
- Personal protective equipment (PPE) must be worn where required.
- CCM accepts no responsibility for injury, damage, or loss resulting from misuse or unsafe operation.
7. Maintenance & Repairs
- The Hirer must not attempt to repair or modify the equipment.
- If a fault occurs, the Hirer must stop using the machine immediately and contact CCM for assistance.
- CCM will arrange repair, replacement, or inspection as required.
8. Liability
CCM’s liability is limited to the repair or replacement of faulty equipment. CCM is not responsible for indirect or consequential losses including downtime, lost profits, or damage to property.
9. Termination
- CCM may terminate the hire and recover the equipment immediately if:
- Payment is not made as agreed;
- The Hirer breaches these terms; or
- The equipment is being misused or is at risk.
- All hire charges remain payable up to the date the equipment is returned or recovered.
10. Insurance
The Hirer is responsible for ensuring adequate insurance coverage for loss, theft, or damage to the hired equipment during the hire period.
11. Governing Law
These terms are governed by the laws of Queensland, Australia. Any disputes shall be handled in Queensland courts or tribunals.
Hire Agreement Acknowledgement
By submitting a hire form, making payment, or taking possession of the equipment, you acknowledge that you have read, understood, and agree to these terms and conditions of hire with Commercial Cleaning Machines Pty Ltd.
